Terms of Service ​

Agreement to Terms ​

By accessing or using the trxy™ mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Eligibility ​

You must be at least 13 years of age to use trxy™. By using the App, you represent and warrant that you meet this age requirement.

Account Registration ​

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account

Acceptable Use ​

You agree to use trxy™ only for lawful purposes. You agree NOT to:

  • Harass, bully, or threaten other users
  • Post content that is illegal, offensive, or violates others' rights
  • Impersonate others or misrepresent your identity
  • Share content depicting dangerous skateboarding stunts that could encourage harmful behavior
  • Attempt to gain unauthorized access to the App or other users' accounts
  • Use automated tools to scrape or collect data from the App
  • Violate any applicable laws or regulations

User Content ​

Your Content ​

You retain ownership of content you post ("User Content"). By posting, you grant trxy™ a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content within the App.

Content Standards ​

All User Content must comply with our community guidelines and safety standards. We reserve the right to remove content that violates these Terms or our policies.

Content Moderation ​

We employ automated and manual content moderation to maintain a safe community. Content may be reviewed, flagged, or removed at our discretion.

Zero Tolerance Policy ​

trxy™ has zero tolerance for objectionable content and abusive users.

Content Moderation Commitment ​

  • All user reports are reviewed within 24 hours
  • Confirmed violations result in immediate content removal
  • Violating users are permanently banned from the platform
  • Severe violations are reported to law enforcement authorities

Skateboarding Safety ​

Important: Skateboarding involves inherent risks. trxy™ is a platform for sharing and celebrating skateboarding culture, not a substitute for proper safety practices.

  • Always wear appropriate safety gear
  • Skate within your skill level
  • Respect private property and local laws
  • Use skateparks and spots responsibly
  • Do not attempt tricks beyond your abilities

trxy™ is not responsible for injuries, accidents, or damages resulting from skateboarding activities.

Intellectual Property ​

trxy™'s Rights ​

The App, including its design, features, code, and branding, is owned by trxy™ and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the App.

Trademarks ​

trxy™, its logo, and related marks are trademarks of trxy™. You may not use these marks without prior written permission.

Third-Party Services ​

trxy™ uses third-party services (including Supabase, Google Cloud Vision API, and Google Perspective API) to operate the App. Your use of these services is subject to their respective terms of service and privacy policies.

Challenges and Competitions ​

  • Challenges are user-created activities and are not officially sponsored by trxy™ unless explicitly stated
  • Participate in challenges at your own risk
  • We are not responsible for disputes between users regarding challenges
  • Challenge content must comply with these Terms and our safety standards

Termination ​

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms
  • Illegal activity
  • Harmful behavior toward other users
  • Child safety violations (zero tolerance policy)
  • Any conduct we deem harmful to the App or community

You may delete your account at any time through the App settings.

Disclaimers ​

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TRXY™ DOES NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • Results from using the App will meet your requirements

Limitation of Liability ​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRXY™ SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Personal injury or property damage resulting from App use
  • Injuries sustained while skateboarding
  • Loss of data, revenue, or profits
  • Any damages exceeding $100 USD

Indemnification ​

You agree to indemnify and hold harmless trxy™, its officers, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your User Content
  • Your violation of these Terms
  • Your violation of others' rights

Privacy ​

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Child Safety ​

trxy™ is committed to child safety. We have zero tolerance for child sexual abuse and exploitation (CSAE).

Reporting to Authorities ​

When we obtain actual knowledge of child sexual abuse material (CSAM) or child exploitation on our platform, we will:

  • Immediately remove the content and suspend the violating account
  • Report to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline in compliance with 18 U.S.C. § 2258A
  • Preserve evidence in accordance with the REPORT Act (2024) and cooperate with law enforcement
  • Report to relevant international authorities for users outside the United States

Changes to Terms ​

We may modify these Terms at any time. Material changes will be communicated through:

  • In-app notifications
  • Email to registered users
  • Updates on this page

Continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law ​

These Terms are governed by the laws of the United States and the state of [Your State], without regard to conflict of law principles.

Dispute Resolution ​

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.

Severability ​

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire Agreement ​

These Terms, together with our Privacy Policy and Safety Standards, constitute the entire agreement between you and Trxy regarding the App.
